Terms and Conditions

These Terms and Conditions govern the use of MakeItTrip as a collaborative platform for shared trip planning, file storage, and AI-supported processing of travel-related content.

These Terms and Conditions apply to the use of MakeItTrip, including the web application, mobile views, and related functions and services.

By registering for, accessing, or using MakeItTrip, the user confirms that they have read and accepted these Terms and Conditions as binding. Mandatory statutory provisions, especially mandatory consumer protections that apply at the user's place of residence, remain reserved.

2. Scope and conclusion of contract

These Terms and Conditions govern the legal relationship between the provider and natural or legal persons using MakeItTrip.

The contract is concluded when a user creates an account, purchases a paid service, or uses MakeItTrip after being informed of these Terms and Conditions. For paid services, the information displayed during the ordering or checkout process also applies.

Any deviating terms of the user shall apply only if the provider has expressly agreed to them in writing.

3. Description of services

MakeItTrip is software for collaborative trip planning. Depending on the product configuration, the platform may allow users to create and manage trips, add, structure, rate, and compare options such as flights, accommodation, or activities, vote within groups, upload files, and use AI-supported import and analysis functions.

MakeItTrip is generally a planning and organization tool. Unless expressly stated otherwise, the provider is not a tour operator, travel agent, airline, hotel, insurer, or other third-party travel service provider. Contracts for flights, hotels, activities, or other third-party services are concluded exclusively between the user and the respective third-party provider.

The provider may modify, expand, restrict, or discontinue functions, technical requirements, user interfaces, storage limits, integrations, and service features at any time to the extent reasonable for the user.

4. Registration and user account

Certain functions require a user account. Users must provide complete and accurate information when registering and keep that information up to date.

Access credentials and authentication factors must be kept confidential and must not be misused or unlawfully shared with third parties. The user is responsible for all activities carried out through their account unless the user proves that they were not at fault.

The provider may reject registrations and may temporarily suspend or permanently close accounts where there are concrete indications of misuse, security risks, legal violations, or breaches of these Terms and Conditions.

5. Free and paid services

MakeItTrip may offer free and paid functions. The specific scope of services results from the current product description, the user account, the checkout flow, and these Terms and Conditions.

Paid services are offered in particular in the form of premium slots for individual trips. Depending on the current offer, users may choose in particular a monthly plan, a 4-month plan, or a yearly plan. Each purchased plan unlocks one premium slot for one trip for the relevant term.

Paid services are account-based and system-based. They may not be transferred to third parties except through assignment or management features expressly provided within MakeItTrip.

6. Premium, term, and payment

Premium services are billed according to the selected term. The details displayed to the user before the purchase is completed are decisive. Unless the checkout states otherwise, a recurring charge applies for the selected premium slot for a term of 1 month, 4 months, or 1 year.

Payments are processed via external payment service providers, in particular Stripe. Their own contractual and privacy terms also apply. The provider does not receive unrestricted access to full payment credentials.

In the event of late payment, failed charges, chargebacks, suspected fraud, or refunds, the provider may suspend paid features, end premium assignments, or restrict access until the matter has been clarified.

All prices are shown in the currency displayed during the order process. The provider may adjust prices for future contracts or future renewal periods at any time. The price and service information shown in the concrete checkout flow prevail over general marketing statements.

7. Expiry or loss of premium

If premium access expires or a corresponding entitlement ends, the premium features linked to the affected trip or account are disabled unless the product description states otherwise.

Content already created generally remains stored in the account, subject to technical limitations, legal obligations, and the deletion and retention rules set out in these Terms and Conditions.

After premium ends, the provider may limit features, restrict write access, reduce storage, or discontinue file and AI functions.

8. Content, rights, and user conduct

Users may use MakeItTrip only lawfully and in accordance with these Terms and Conditions. In particular, users must not upload, store, distribute, or link to content that is unlawful, abusive, discriminatory, deceptive, glorifies violence, pornographic, malware-infected, otherwise impermissible, or infringes third-party rights.

The user represents that they hold the rights required for the content they upload or enter. For the duration of the contractual relationship and to the extent required to operate MakeItTrip, the user grants the provider a non-exclusive, worldwide, sublicensable right to store, technically reproduce, display within the groups controlled by the user, process, and use such content for import, analysis, security, backup, and service operation purposes.

Reverse engineering of the platform, automated mass queries without authorization, circumvention of technical protection measures, disruption of operations, abusive load testing, and use of the platform for unlawful or unauthorized purposes are prohibited.

9. File uploads and storage

Depending on the tariff and feature set, users may upload files such as PDFs, images, and other trip-related documents. Storage may be provided through external infrastructure and cloud providers, including services such as Cloudflare R2 or comparable storage solutions.

The provider may define and change permitted file types, file sizes, storage limits, retention periods, security checks, and access restrictions for technical and organizational reasons.

If a premium slot ends or storage or usage limits are exceeded, files may remain available only to a limited extent. Files may be permanently deleted after a provider-defined period, including approximately 90 days without an active premium entitlement for the relevant function, unless legal retention duties require longer storage.

Users remain responsible for maintaining their own backups. MakeItTrip is not an archival system and does not replace an independent backup solution.

10. AI functions

MakeItTrip may offer AI functions for automated extraction, structuring, summarization, classification, or other processing of content, in particular for bookings, PDFs, images, links, or text input.

AI-generated results may be incomplete, inaccurate, misleading, or outdated. They are provided only as assistance and do not replace human review, binding travel advice, or legal, tax, medical, or other professional advice.

Users must independently verify AI-generated outputs before relying on them for sharing, booking, planning, or decision-making. There is no claim to specific results, availability, completeness, or factual correctness.

11. Availability and technical requirements

The provider seeks to ensure a high level of availability and security of the platform. However, there is no entitlement to uninterrupted, error-free, or permanently available operation.

Maintenance work, updates, security measures, capacity bottlenecks, third-party outages, telecommunications failures, or other technical events may temporarily restrict or prevent use of the platform.

Users are responsible for their own end devices, internet connection, browser or app versions, and the secure use of their account.

12. Data protection

Personal data is processed in accordance with the separate Privacy Policy in its current version.

Where the provider processes personal data in connection with the services, the applicable data protection laws apply, in particular Swiss data protection law. Where AI, hosting, infrastructure, or payment service providers are used, data may be transferred to or processed by such recipients to the extent required for service performance.

13. Warranty and liability

The provider does not warrant that MakeItTrip is suitable for any specific purpose, compatible with every third-party application, or available at all times without interruption or error.

The provider is liable without limitation for damage caused intentionally or through gross negligence by the provider and in cases of mandatory statutory liability. To the extent permitted by law, any further liability is excluded or limited to typical and foreseeable damage.

In particular, to the extent permitted by law, the provider is not liable for indirect damages, consequential damages, lost profits, lost savings, loss of data, inaccurate or incomplete AI outputs, failed or incorrect third-party bookings, group decisions made on the basis of platform content, or outages of third-party services such as payment, hosting, cloud, communications, or AI services.

Where a limitation of liability would conflict with mandatory law, including any inadmissible exclusion of liability for intent or gross negligence, the legally permissible rule shall apply instead.

14. Term, suspension, and termination

The agreement for free use runs for an indefinite period and may be terminated by the user at any time by deleting the account, unless statutory or contractual obligations require continued retention or processing.

Paid services end in accordance with the booked term or after effective cancellation or termination under the conditions shown in the order process, user account, or payment provider flow. If a model is structured as a recurring subscription, it renews in accordance with the conditions shown in checkout or by the payment provider until effectively canceled.

The provider may suspend or terminate the contractual relationship without notice for good cause, especially in cases of misuse, security incidents, late payment, chargebacks, legal infringements, or serious breaches of these Terms and Conditions.

15. Amendments to these Terms and Conditions

The provider may amend these Terms and Conditions for the future where there is an objective reason to do so, in particular due to changes in law, technical infrastructure, security requirements, product functions, or the business model.

Registered users will be informed of material amendments in an appropriate manner. If the user does not object within a reasonable period and continues to use MakeItTrip after the amendment takes effect, this may be treated as acceptance to the extent permitted by applicable law.

Additional mandatory statutory requirements remain reserved, especially for paid contracts and mandatory consumer rights.

16. Governing law and jurisdiction

Swiss substantive law applies, excluding conflict-of-law provisions and, to the extent permitted, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

To the extent permitted by law, the place of jurisdiction is the provider's registered seat in Switzerland. Mandatory statutory places of jurisdiction and mandatory consumer protection provisions remain reserved.

17. Final provisions

If any provision of these Terms and Conditions is or becomes wholly or partly invalid or unenforceable, the validity of the remaining provisions shall not be affected.

The invalid or unenforceable provision shall be replaced by the legally permissible provision that comes closest to the economic purpose of the original provision.
